政府採購法第八十五條之一第二項“先調後仲”機制疑義:強制仲裁是否必要?

A Study on Article 85-1 of Government Procurement Act: Shall the Compulsory Arbitration be Maintained?

摘要


自民國(下同)九十六年七月四日公佈施行修正政府採購法(下稱「採購法」)第八十五條之一條款以來,就公共工程履約爭議採行「先調後仲」機制,引發國內實務界與學術界熱烈迴響。修正採購法產生的爭議性極大,不僅在實務面上值得觀察其執行成效,在制度面上也有檢討此一修正是否妥當適宜之必要,特別是關於「強制仲裁」的規範:以片面拘束機關同意仲裁的方式,是否能夠確實收到既可提高調解成立之機會,又可藉由仲裁程序迅速適當地解決紛爭,即所謂「一石二鳥」的效果?「強制仲裁」果真毫無疑義,在制度上無其他更好的方案可以替代? 本文以制度面切入,討論修正採購法選擇「強制仲裁」時所可能造成的衝擊與瑕疵,並嘗試從功能性的角度分析所謂「強制仲裁」制度究竟有無存在之必要,以及所可能替代此一制度的方案。

The Government Procurement Act has been amended on July 4, 2007 for Article 85-1, which states, ”In the event that the unsuccessful mediation of construction work due to the entity does not agree with proposal or resolution for mediation proposed by CRBGP, the entity may not object to the arbitration filed by the supplier.” Some Taiwanese lawyers recognize this article as a new type of compulsory arbitration. It has also inspired lots of arguments between patricians and scholars. This thesis tries to analyze the conflicts and the defects raised by the compulsory arbitration system. It also provides a functional vision in regard to the necessity of this mechanism. In conclusion, this thesis suggests importing others ADR model, such as Med-Arb in dispute settlement of government procurement system. In order to accord with arbitration theory, this thesis also advocates that the compulsory arbitration system shall be deleted.
