數位出版品版權發行管理施行機制

Digital Publications Right Issuing Management Practice Mechanism

摘要


數位內容產業具有發展知識經濟與數位經濟雙重指標意義,除可促進傳統產業提升知識含量,使其轉型為具更高附加價值之產業外,亦為提升我國整體產業全球競爭力之基礎。為落實知識經濟的發展,俾以數位內容產業領導華文市場,政府已於91年5月核定通過「新世紀兩兆雙星產業發展計畫」,行政院亦於同年5月核定通過「加強數位內容產業發展推動方案」,祈能運用台灣產業既有的優勢及文化特質,加強發展台灣數位內容產業,俾建構成為亞太地區數位內容開發設計暨製作中樞,並帶動週邊衍生知識型產業發展。針對目前國內數位出版品所欠缺的商業模式與付款機制,本文提出一個安全、公平、簡便且有效率的數位出版品版權發行管理機制,使其能克服因數位出版品在網際網路上流通、進行交易等行為所衍生的相關問題,除能保護數位出版品之智慧財產權,進而鼓勵創作更多優質的數位出版品之外,亦能保護消費者個人及交易資料,並提供消費者和數位出版品提供者端可能衍生之交易機制,使其能有效活絡數位出版品的流通交易。

Digital contents industries have the dual significance of the development of knowledge economy and the digital economics. Except promoting the knowledge content of the traditional industry, causing its reforming to industries that have the higher attachment value, it can also promote the overall industry global competition strength of our country. In order to carry out the development of knowledge economy and lead Chinese market by digital contents industries, our government has listed the digit contents industries as ”The new century's two trillions double stars industries development plan” in 91 year. The Executive Yuan has also passed the ”Strengthens digit contents industries development impetus plan” in May at the same year, hoping to take the advantages of using the superiority and the cultural special characteristic of the Taiwan industry and strengthen the Taiwan digital contents industries, in order to make Taiwan become the main center of the digital contents developments in the Asian and Pac ific. In view of the lack of a business model and the payment mechanism in the present domestic digital publications, this paper proposed a security, fair, simple and effective mechanism for the digital publications, to solve the problems which the publication encounter when circulates and transacts in the Internet. Excepting protecting the wisdoms and property rights of the publication, furthermore it can encourage the creation of more high quality digital publications, keep the transaction secret of the consumer, protect the deliverable transaction of the consumer and digital publication provider, and effectively detach digital publication circulation.
