摘要

國會運作是西方民主國家中政治運作的重要核心，國會中的委員會制度更經常被認為是能否發揮專業立法功能，以及能否扮演好守門角色的關鍵。經過檢視美國與我國政治學界對於委員會的研究成果之後，可以發現，委員會研究是國會研究中，非常重要的部分，但研究途徑和分析架構都頗為分歧，呈現了多層次的研究觀點。本文旨在進行我國立法院之法制規範研究，以及重要的議事運作制度，以作為探討委員會實際運作真貌之基礎。本研究從法制面切入，比較分析美國與台灣在委員會制度運作的差異，同時輔以探討當前我國立法院實際之議事運作時，委員會所涉及的職權及其內規，進行理論與實證的初步結合，希望能有助於對於我國立法院中委員會運作之瞭解，以釐清在立法院運作中委員會所真正扮演的角色與功能，並作為日後理論化研究之基礎。

Parliament is the core of the political operation in the Western democratic countries and the committee system in Congress is more often thought to be the key point if it can bring professional legislative functions into full play, and play as a good gatekeepers. After viewing those important research results on studying committee of the Congress by the United States and China's scholars, we find that it is a very important part of study committee of the Congress, but it is discrepancy between the research approach and analytical framework, and what they presented is a multi-level view. This paper aims at the study of legal norms of the Legislative Yuan, as well as the important rules of how to arrange the Commission as the basis for the committee actual operation. From the legal side angle, we compare and analyze the difference between the operations of the committee system in the United States and Taiwan and simultaneously supplement the Committee's mandate and its internal rules concerning as the actual operation at China's Legislative Yuan. With the preliminary theoretical and empirical integration, we hope to contribute to our understanding of the operation of the committee of Legislative Yuan to clarify the real role and function which the Committee in the Legislative Yuan plays as it is really in practice and to take it as a basis for future theoretical research.
