警察執法與人權之維護－以釋字五三五號解釋為中心

摘要

大法官會議於民國九十年十二月十四日作成了釋字第五三五號解釋，針對警察行之多年臨檢執法的要件、程序及違法臨檢救濟等方面，作明確闡釋及規範。成為自違警罰法被宣告違憲後另一對警察執行勤務法制的衝擊，其影響甚為深遠。本文以人權保障之著眼點切入，並就警察勤務條例，警察職權行使法，以及行政程序法等相關警察執法法制與人權保障之層面提出若干重點及平議。

Due process, especially the police procedure, is a constitutional principle that the government must respect all of the legal rights owed to a person according to the law and the constitution. When a governmental activity harms a person without following the exact course of the law, it constitutes a due process violation which offends against the rule of law. This article mainly and briefly focuses on the justification of procedure conducted by the police force. Only when the justifications were completely fulfilled, could the constitutional rights of the people be realized and guaranteed.
