體育教學與法律問題分析-以玻璃娃娃事件爲例

摘要


「法律之前,人人平等。」(世界人權宣言,1948)爲了保障人民的基本權利與自由,政府之施政均須以憲法精神爲依據。同理,體育教師在施教時,一切亦應以「法」爲依歸,不可有所踰越,才可維護他人及自身之權益。本人僅藉著玻璃娃娃案例的呈現,讓人更能清晰明瞭各項法條之權利、義務關係,俾能做爲體育教師教學時之參酌依據。

”All are equal before the law”. (Universal Declaration of Human Rights, 1948). To protect people's fundamental rights and freedom, the government must follow Constitutional Law when taking any measures. Likewise, physical education teachers must abide by the law in the process of teaching. They cannot do anything beyond the law, so that they can protect the rights of themselves and others. In this thesis paper, I present the case study of ”brittle bone” disorder to help PE teachers be more clearly aware of the rights and obligations in law, and offer the documentary basis for PE teachers to refer to while they teach.
