全球化觀點與普世適用原則對加入世界衛生組織之探討:以台灣角度分析

The Discussion of Viewpoints of Globalization and Universal Application Principle for Jointing the WHO: Analysis of Taiwan Issue

摘要


本文主要是以全球化與普世適用原則的觀點去探討台灣加入世界衛生組織(WHO)的原因。為了落實國際衛生條例的執行與促進人類福祉的目標,希望藉由加入世界衛生組織來防止流行性疾病跨國界之傳染。由於受政治力之干預,台灣無法成為世界衛生組織之會員國,形成嚴重的防疫漏洞。故本研究希望從全球化之國際分工角度出發,說明台灣醫藥產業之對世界奉獻除需要與先進國家積極合作外,並繼續扮演對落後國家醫療援助的角色。此外,根據『普世適用』之規定,說明台灣無法被排除參與國際事務之外,並成為台灣日參與世界衍生組織所規範相關活動足法理基礎。

This study discussed the viewpoints of globalization and Universal Application Principle for joining the World Health Organization (WHO). To practice the International Health Regulation and to reach the maximization of human welfare, Taiwan should take part in the activities of the WHO to prevent the increase of contagious disease worldwide. Due to political interference, Taiwan cannot to be a member of the WHO, and become a loophole of Global Outbreak Alert and Response Network. This paper also briefly stresses the importance of Taiwan medical contribution to the world by way of empirical analysis and international division of labour. Therefore, Taiwan has to cooperate with other developed countries? in order to improve its medical industry, and to connect the bridge for medical aid to the developing countries. Moreover, based on the Universal Application Principle, Taiwan should not exclude front the participation of international affairs, and this principle may transform into the legal protection for Taiwan joining the WHO.
