我國總統彈劾制度之研究

本文主要係從彈劾的意義與緣起，總統直選國家的彈劾制度，以及我國彈劾總統的制度變遷等面向，評價我國現行彈劾直選總統的制度。本文的研究指出，現行彈劾總統的機關為立法院，但由於立法院已淪為朝野政治競逐的戰場，故對於彈劾總統權力之行使，自難擺脫政治抗爭的考量。因此，有關彈劾總統的提出機關，不宜僅限於立法院，而應恢復憲法本文中監察院彈劾總統之權力，採立法院、監察院雙軌並行制，如此也能符合憲法第九十條：「監察院為國家最高監察機關，行使同意、彈劾、糾舉及審計權」規定的本意。

This article mainly discusses that meaning and origin of impeachment, and evaluates Taiwan presidential impeachment system through several dimensions including the presidential impeachment system of direct-election countries, the change of the presidential impeachment system of Taiwan. This article points out that the exercising impeachment institution is Legislative Yuan, but LY has already become the political battlefield between ruling and opposite parties. According to this reason, LY hardly gets rid of the consideration about political protest when exercises the right of presidential impeachment. Therefore, about the institution which can exercise the right of presidential impeachment, should not limit in LY but also restore the right of Control Yuan to exercise presidential impeachment which is original regulated in Constitution of R.O.C. So, according to the analysis, it should adopt ”Legislative and Control Yuan” dual-track system, and it might conform the original meaning of article 90 of Constitution which is that ”Control Yuan is the highest control institution of the Country and exercise the rights of agreement, impeachment, redress and audit.”
