原住民族傳播權利之探源及詮釋

摘要

國內有關探討原住民傳播權的論述尚不多見，對於少數族群的傳播權利並未有過較深入的探討，有限的論述也多半集中在接近使用權方面，未能涵蓋傳播權的整體概念。故本研究希望能詳細探討原住民傳播權利的根源，釐清其性質，確立其定位，並詮釋其意涵之所在。本文為追本溯源，首先將探討「傳播權」此一概念的根源及立論基礎，並陳述不同背景觀點及其變遷的歷程。其次再將焦點放置於原住民族之傳播權利，其權利的來源為何；尤其是集體權的觀念出現之後，媒介權和傳播權如何漸漸成為原住民族訴求的重要權利之一。而後將各類國際條約和宣言中，有關於原住民傳播權的部分予以逐條列舉，並加以歸納及分析其性質和意涵，整理出三大類共十四項有關傳播權利的概念，分別陳述之，藉此來主張原住民族的傳播權應該和發展權、文化權、環境權等其他集體權利列於同等位階，一方面深化原住民傳播權的內涵，同時也為其權利位階確立正當性，以彰顯其重要性和實踐意義。

Studies on indigenous people's communication rights appear very rarely in the academic community, and those that do, do not discuss the communication rights of minorities in depth but focus rather on the right of access to the media, ignoring a holistic perspective. This paper discusses the origin of indigenous people's communication rights, clarifies them, establishes their position, and interprets them. First of all, we discuss the origin and foundation of the concept ”communication right,” state different points of view and the process of change in the concept. Secondly, we focus on a definition of the basic concept of communication rights of indigenous peoples, especially the understanding of them as collective rights, and how media rights and communication rights can become a key demand of indigenous peoples. Afterward, we analyze United Nations' and international organizations' documents on indigenous people's communications and elaborate three categories of indigenous people's communication rights with 14 separate items. We claim that the communication rights of indigenous peoples include the rights of development, to culture and to a healthy environment.
