從學生權益談友善校園學生申訴制度的建立

The Establishment of the Appeal System for Students on Friendly Campuses: From the Perspective of Student Rights

摘要


長久以來,教育部持續推行「友善校園整體營造計畫」,希望藉由此項計畫之推行,使學校教育活動,能夠建立在「關懷、平等、安全、尊重、友善」的基礎上,塑造一個溫馨和諧的校園環境。本文嘗試從大法官會議解釋與學生申訴制度相關法令之修正歷程,探討大學友善校園總體營造計畫下學生申訴制度與教育部政策、國家法令間之關聯,友善校園申訴制度對大學校院的實質影響並進行問題剖析,最後針對現行學生申訴制度實施提出若干建言。

For a long time, the Ministry of Education has continued to implement the "Friendly Campus Overall Construction Project". It is hoped that through the implementation of this project, school education activities can be built on the basis of "care, equality, security, respect and friendliness," a warm and harmonious campus environment. This paper attempts to explain the revision process of the relevant laws and regulations related to the student appeal system from Grand Justices Council, and explores the relationship between the student appeal system under the overall campus construction plan and the policies of the Ministry of Education and national laws. Furthermore, this paper will discuss how the friendly campus appeal system affects colleges and universities, and, finally, offer some suggestions for the implementation of the current student appeal system.
