公共資產營運管理委託作業案例之研究

公共資產委託民間辦理之案件，因中央、地方之不同，而有不同之法令依據，基本上皆有明確之規定可供遵循。惟因機關屬性不同、承辦員業務嫻熟度差異，導致招商委託過程常有一些爭議出現。加以此類型案件在各機關中多屬少量之個案，不像一般採購按易於獲得協助或累積大量經驗，在缺乏實例之參考下，往往有部分適法性問題而產生些許瑕疵。而此類案件又常具商機，因此如何做到公正、公平、公開而不至於產生紛爭，亦是急為重要之事。由於相對於一般採購而言，此類案件仍屬少量，相關研究亦有待加強。本文即蒐集相關案例進行研究，並就其經營管理與招商委託過程間之關聯性加以分析，探討其中之缺點與錯誤，最後提出正確作法與建議。

Central and local government authorities have explicit legal provisions that apply differently to public properties and assets that are privately managed. Due to the difference in law and regulations governing public and private actors, imperfections arise in private management creating a lack of efficiency in performance of their assigned job function. The level of service provided to agency officers is also significantly affected, often resulting in debate over the process that should be followed. Moreover, there are relatively few cases involving this form of private operation management. This lack of precedence often raises legal questions during private management. Therefore, there is more of an emphasis on achieving justice fairness and overall equity in these often lucrative cases. This study analyzes relevant cases looking at the correlation between the entrustment process and operation management. From this analysis, the advantages and disadvantages of operation management is discussed in detail. Finally, the study proposes suggestions and new methods that could be used to enhance operation management of private entrustment.
