食品安全保護基金之設立沿革與運作實務

The Establishment and Operation of Food Safety Protection Fund

摘要


近年來國內食品安全事件頻傳,為保障消費者之權益,食品安全衛生管理法於103年1月28日修正明定設立「食品安全保護基金」,其設置係參考國內相關基金制度及犯罪被害人保護法之精神,明確規範基金用途、來源及管理方式,以妥善分配及利用基金資源,落實保障民眾飲食安全權益。本文除介紹食品安全保護基金之設立沿革,同時將重點說明其運作方式、經費來源及法源依據。食品安全保護基金自104年1月1日啟動迄今,已審查核定5件由消費者保護團體提起之消費訴訟,並由食安基金予以補助律師報酬及訴訟相關費用。未來,食品藥物管理署將持續落實食安基金之運作,以達維護全民食品安全之宗旨。

In recent years, domestic food safety incidents happened frequently. For consumer protection, Act Governing Food Safety and Sanitation was amended on January 28^(th) 2014 and established "Food Safety Protection Fund", which is based on domestic relevant fund system and the Crime Victim Protection Act, regulate fund uses, explicit sources and management, in order to have proper allocation and use of resources to implementing the protection of food safety rights. Besides the establishment of "Food Safety Protection Fund", this article describes the evolution of the fund, while highlighting its operation, funding sources and legal basis. Moreover, since the launching of Food Safety Protection Fund on January 1^(st) 2015, it has been used for the review and approval of 5 cases proposed by consumer protection groups, and to subsidize the relevant litigation cost. In the future, the Taiwan Food and Drug Administration will continue to implement the operation of the Food Safety Protection Fund, in order to achieve the purpose of maintaining food safety.
