輸入食品邊境管理之具結先行放行制度之彙整

具結先行放行係我國對於輸入業者於輸入檢驗時間超過五日、在貨櫃場抽樣困難、容易腐敗或變質，或以貨船直接裝載且碼頭無貯存處之產品，為輸入產品之衛生安全及我國邊境查驗之型態所特別制定之制度。本文介紹美國、日本、韓國、新加坡、澳大利亞、紐西蘭等國及歐盟之輸入食品邊境查驗加速通關之相關規定，並進一步引入雙邊協議及國際協議，再介紹我國現行食品安全衛生管理法之具結放行制度及其架構規範，經比較我國與其他國家相關規定，各國政府對於輸入食品在邊境通關之管理，皆依據產品風險高低，採行不同管制措施，而具結先行放行制度實為防堵問題食品及相關產品輸入我國，同時又為因應我國邊境硬體條件、產品性質等需求之下而產生之制度。

＂Prior Release＂ is formulated for imported products which are required for examinations that take more than five days, of difficulty when sampled in the container yard, perishable, or transported in bulk without appropriate storage place in wharf. In this article, we summarized the international agreement and border control practices of the United States, Japan, Korea, Singapore, Australia, New Zealand, and the European Union on food imports. The related requirement for the prior release stipulated system in ＂Act Governing Food Safety and Sanitation＂ and ＂Regulations of Inspection of Imported Foods and Related Products＂ were also outlined. This short review concluded imported products are regulated at border based on their risk coming countries. The prior release system is applied in order to block unqualified products from into Taiwan, while fit border control details and according to the properties of the imported products.
