Security Policies and Fundamental Rights in Germany

摘要


雖然懲治不法及維護安全是項古老的刑法任務,但自2011年911事件發生後,維安政策的強度與人權保障之間的權衡已再度成為當代重要的法制課題。在德國,維安機關想要獲得更廣泛的資訊蒐集權限這種需求,以及相對於此,各種希望能限制這些權限的努力,在最近這段時間都受到更加清楚的審查檢視。本文作者認為,德國聯邦憲法法院所建構的體系為基本權提供了有效的保護。

Although control of lawlessness and maintenance of security is a venerated role of criminal law, yet since the September 11, 2011, attacks, the balance between heightened security policies and protection of human rights has become an important topic in legal circles today. In Germany security agencies seek to acquire ever wider powers to gather information. In contrast efforts geared towards limiting these powers have also been the subject of clearer judicial oversight in recent times. The author of this paper argues that the system established by the Federal Constitutional Court in Germany provides effective protection for fundamental rights.
