校園國家賠償責任之探究

摘要

學校是保障學生學習權的主要場所。學校人員應該保護學生生命與身體安全。學校必須提供學生完善的教育環境與教學設備。假如學生的自由或權利受到學校人員不法侵害或因公有公共設施設置或管理欠缺而受到損害時，可依國家賠償法請求賠償。本文嘗試從國家賠償責任的角度切入，由學校人員作為公務員的國家賠償責任，以及學校做為公共設施的國家賠償責任，論述教師和學校是否成立國家賠償責任。

Schools are the main places to protect the students learning right. School members must protect students' life and body security. Schools should offer the superior educational environments and teaching to students. If students' freedoms and rights are damaged illegally by the school members or because of lacks of the establishment and the management of infrastructures, parents could apply for compensations according to the State Compensation Law. This paper tries to discourse that whether school members, as public functionaries of state compensatory liability, and schools, as state-owned public facility of state compensatory liability, can establish state compensatory liability or not.
