In the perspective of labor legal system, ”unpaid leave” should be a virtual ending (suspension) of labor contract. For helping employers and employees to tide over the crisis, the government should start the mechanism of employment security and employment insurance to maintain public order.Unpaid leave is no doubt an ongoing fact in the society. Unaffected by the current law, Abe Yasutaka’s legislative policy theory aims at fulfilling certain purpose of policies and formulate solutions. Abe Yasutaka's theory is also adopted in this study from various ways, including the analysis of empirical side of unpaid leave, the legal meaning of unpaid leave, the legal relationship between unpaid leave and minimum wage, the influence that the virtual ending (suspension) of labor contract brings to unpaid leave and the appropriate process of vocational training measure and unpaid leave. With conclusion and suggestion, this study would like to contribute to different fields of employer-employee, politics and academia.
