日本勞動派遣法制之變遷與意義分析

A total review over the transition concering the Japan's labor dispatching legal system

摘要


日本勞動派遣法(譯稱自:「勞動者派遣事業の適正な運営の確保及び派遣勞動者の保護等に関する法律」,1985年7月5日,法律第88號)(以下簡稱:日本勞派法)至2016年底止,施行已歷30餘年。日本勞派法制簡言之,是執政者與資本家間有關人力使用上之「幻想」。30餘年來,日本勞派業興盛下,日本企業不必擔心勞動力之獲得,但日本經濟卻未因此起色,而且日本社會整體之工作滿意度,亦呈下降。尤其,勞派型勞動者因在勞派業者之「中間剝削」下,「工作貧窮」已澈底扭曲日本的社會結構。準此,我國不宜再參考日本做法,不宜再容許勞派業者,如同寄生蟲式之存在。

The labor dispatching (「LD」as follow) law has passed 30 years, untill 2016。Japan 「LD」law, simply to say, it is nothing but an illusion about the usage of human power between the parey in power and the capitalists。While in these 30 years, since the「LD」traders are prosperous, the entrepreneurs do nothing worry about to get the human power, in spite of the restoration of Japanese economy is deficient, and the whole Japan satisfactory degree of the task is coming down。Especially,「LD」labors encounter the 「exploitation」from the 「LD」entrepreneurs, the Japanese social mechanism is totaly change, and it is just because the phenominum of the「the workers of poverty」。Therefore, my country must prohibit the「LD」traders like Japan’s one。 Because they are equal to the parasitic worn。
