家事專家調解委員評選之研究

本研究旨在探討家事事件專家調解委員評選之決策問題。人才遴選為一多準則決策的問題。我國各地方法院對於家事專家調解委員，雖得依法評選，惟所考量的準則多元問題複雜，因此有必要以一系統化的方式，使評選過程能有具體指標並掌握評選重點。本研究採問卷調查法，採用層級分析法建構家事專家調解委員之評選指標及相對權重，以作為人才評選策略擬定與實施之參考。本研究之結論如下：一、根據文件分析與專家訪談之結果，家事專家調解委員評選之決策考量因素包括：「品行端正，著有信譽」、「工作富有熱忱」、「身心及生活狀態之許可」、「具有溝通調解紛爭之能力」及「具有專業知識或解決家事紛爭之經驗」等五項準則；而次準則包括家事調解經驗、取得專業相關證照等二十二項指標。二、本研究根據相關調解制度法規及家事事件公益非訟性原則之觀點，建構家事專家調解委員評選決策模式。此決策模式經實務專家再度確認，證實此決策模式可作為決策者在實務運作上之參考。

The purpose of this study was to construct the decision model of the expert committee selection for Family Mediation which is suitable for the courts in Taiwan. Mediator selection for the expert committee of Family Mediation is a multi-criteria decision making (MCDM) problem. Since the criteria are multiple and the process for mediator selection of Family Mediation committee is complicated; a systematic and effective tool, is needed. According to the results of the literature review and the professional opinions of experts at courts in Taiwan, the evaluation criteria were selected and transformed into questionnaires, and the decision model was reconfirmed. Deta were collected by administering the questionnaire to twenty-one experts at courts in Taiwan who have the experience of taking part in the committee selection of Family Mediation for the courts in Taiwan. The weight for each criterion was calculated by the Analytic Hierarchy Process. The indicators and the weighted system provide with not only key points when selecting expert committee for Family Mediation, but also an important reference when making decisions for expert committee selection.The conclusions are summarized as follows: (1) The decision model for expert committee selection of Family Mediation includes five criteria and twenty-two sub-indicators. (2) The decision model for the Expert Committee selection of family mediation is based on the relative rules and the principle of non-contentious. The results calculated by the decision support model were confirmed to be a useful reference for decision makers during practical implementation.
