我國國民年金保險監理模式的探討

A Study on the Model of National Pension Insurance Supervisory System in Taiwan

摘要


我國國民年金法,業於2008年10月1日施行,同步成立國民年金監理會以監督國民年金保險業務及審議保險爭議事項。有鑑於國民年金攸關被保險人未來老年經濟安全,且其制度運作將影響被保險人參加國民年金保險的意願與信心。因此,國民年金監理體制及財務管理機制的健全,至屬重要研究議題。惟依「國民年金法」的規定,國民年金保險的業務由內政部委託勞工保險局辦理,內政部與勞工保險局兩單位,為不具隸屬機關的業務「法定委託」關係,在欠缺行政隸屬關係下,內政部國民年金監理會對勞工保險局的指揮監督係透過「法規命令」及「行政規則」訂立監督條款,確認彼此權利義務的範圈。目前相關監理法規制度是否已臻周延並足以確認彼此權利義務的範圈,又其監理運作方式,及效率效能是否得以再提升,實有必要進一步研究。本文研究重點,在於檢析國民年金保險主管機關、監理機關及執行機關的權責與定位以及探討如何強化國民年金目前監理法規制度、運作方式及效率效能,並對未來國民年金保險監理組織體制及監理模式提出建議的方向。

Taiwan implemented the National Pension (NP) since October 1, 2008. The National Pension Supervisory Commission was set up simultaneously for the supervision of its administrative affairs. The effectiveness of the scheme will have a direct impact on people's confidence and trust toward the NP, which is an important scheme for the protection of older people's economic security, Therefore, the evaluation toward its supervisory structure is an important subject for academic research. This study aims to explore major issues on the organizational framework and operational mechanism for the NP. The analysis includes the following dimensions: (1) Reviewing the organization arrangements of the NP supervisory committee and Labor Insurance Bureau; (2) Analyzing strategies for improving NP supervisory regulations and operational efficiency; (3) Discussing the possibility and strategy for building a better supervisory mechanism on regulatory management. Following detailed discussion on major findings, this paper provides several suggestions for future adjustments for the operational mode and organizational framework. Necessary amendments for supervisory regulations are also proposed.
