售屋與購屋資訊不對稱下交屋手冊之功能與製作-以預售屋為例

摘要


在全球的不動產市場中,台灣是最先於1960年代創造出預售制度,並進而流行於中國大陸;是故,台灣的預售制度於現今全球的不動產交易市場中,係屬異數。然而,買一棟屬於自己的房子,是每個年輕人的夢想。惟在購買預售屋時,時常會於交屋後,產生一些交易糾紛。例:廣告平面圖與核准的施工平面圖不相符、建物的外觀、設計、格局配置與施工平面圖不相符、廣告所標示的建物用途與「建造執照」或「使用執照」所記載不相符合…等。是故,為了減少交屋後,買賣雙方產生交屋上的相關爭議、糾紛與不悅,因而本研究擬根據交屋後相關爭議,訂定出於交屋時,有哪些項目為買方需交付予賣方,以達在買賣雙方資訊不對稱下,減少買賣雙方於交屋後的相關爭議與糾紛。本文擬彙整出國內常見預售屋交屋糾紛類型並以國內預售屋買賣契約作為輔助來設計問卷,再者透過深度訪談「建築師」、「地政士」、「不動產估價師」、「仲介業者」及「其他民間相關機構或政府部門」…等並從逐字稿中,彙整出其相關看法與見解,最後藉由實證分析之方式,將所得到之成果,作為本論文之結論。

In the global real estate market, Taiwan created pre-sale system at first in 1960, and after that the pre-sale system is popular in mainland China. So the pre-sale system in Taiwan is very different from the real estate trading market in the whole world nowadays. However, it is a dream for young people to buy houses of their own. But there are often some disputes after trading houses when they buy pre-sale houses. For instance: The advertisement plan is different from the construction plan. The appearance, design and the disposition of the pattern of the building are different from the construction plan. The purpose of the building from the advertisement is different from that on the "Construct license" and the "Use license." Therefore, in order to reduce some relative debates, disputes, and unhappiness when trading houses between buyers and sellers after consumers buy the pre-sale house, this research has made some items to help it. That is according to the relative disputes after trading houses; we set some items that the buyers should give to the sellers, so that it can reduce the relative debates, disputes when trading houses between buyers and sellers under the asymmetric information between buyers and sellers. We plan to collect some disputes of the types of pre-sale house in Taiwan and make questionnaire on the help of the documents of some domestic. And in this article we will deeply interview some "architects", "land administration agents", "real estate appraisers" and other departments related. We will comply relative views and opinions from words to words. Finally, by way of empirical analysis, the results will be obtained as a conclusion of this study.
