都市更新事業權利變換制度探討

The Study of Property Rights Exchange for Urban Renewal Business

摘要


權利變換中有風險因素的存在,而風險會造成爭議產生。藉由文獻回顧探討都更中權變法條及程序面,透過分析各國對於權變概況了解與台灣之差異,彙整出風險因子作為本研究架構,針對擬定、核定及執行階段來訪談,將收回資料進行爭議等級平均,及對權變中造成爭議之因子做解釋。依五大構面中可能產生爭議之高風險因子做等級排序。依據受訪者回饋,擬定階段「實施者具有強大主導力與決策權力」、核定階段「更新事業計畫書重建區段之建築設計定案後如再更動,則影響權利變換計畫甚鉅」、執行階段「民眾缺乏基本知識」被認為是造成爭議之因子。而五大構面之風險因子,法制面「權益人無法對權利變換計畫行使同意與否決權」,估價面「土地相關權利人無法參與估價過程」、「價值查估委託全由實施者一手掌握,土地所有權人僅有異議一途,且不得停止都更事業進行」,異議與申訴面「民眾缺乏基本知識」,執行面「如更動計畫花費大量時間及人力」之爭議風險最高。

The property right exchange stage have some risks, and these risk will let dispute comes. By literature review to explore the law and the procedure of the urban renewal Property Right Exchange. Try to find the different among Taiwan and other city of the general situation of property right exchange. This studyfindsrisk factors of the dispute in connection with the highest risk, the approval stage and stage of the implementation. According to the Respondent opinions, the legal aspect of "right of the people who can't consent and veto the property right exchange plan", the valuation aspect of "right of the people who can't participate the evaluation process", the objection& appeal aspect of "the public don't have common sense", the execution aspect of "if change the plan will cost lot of time and human resource" is high risk of the dispute.
