承攬運送人與委託人訂立承攬運送契約,再與一運送人訂立運送契約,運送委託人交付之貨物,因此運送人、承攬運送人、委託人形成一三面關係,而牽涉到所謂第三人損害賠償的問題。其間牽涉到數個專屬於此領域之重大爭議問題,特別是在承攬運送人的義務與權利方面,前者即承攬運送人是否有義務擔保運送之完全履行,後者即承攬運送人之報酬請求權,均存在著根本上之爭議,特為文介紹之。
In practice, forwarders first make forwarding contracts with their customers and then carriage contracts with carriers before transportation is started. Thus forwarders, customers, and carriers are in a triangular situation and the legal problems among them are very complicated. The German forwarding business rule has been amended on July 1st, 1998. In this article, the author discussed by way of comparison, some points of the relevant controversies, especially about the legal rights and duties of forwarders: Do forwarders have to be fully duty-bound to guarantee the whole fulfillment of transportation? Could shippers arise legal claims against forwarders?
