摘要

本研究之目的在於檢討海岸法草案並提出修正案。海岸法草案有一些瑕疵，其中最重要者是：海岸保護區及海岸防護區不能有效達成該法案之目的—維持海岸地區之維護及開發間的平衡。海岸綜合管理計畫之概念應取代海岸保護區及海岸防護區的概念。在海岸綜合管理計畫的基礎上，來建構有關海岸之維護及開發之法制。

The research is to examine and revise the Draft Articles of Coastal Zone. There are some defects in the Draft Articles. The major one is that the concepts of the preserved coastal area and the protected coastal area fail to achieve the goal of the Draft Articles as a whole, which is to maintain the balance between the preservation and the exploitation of coastal zone. A new concept, the intergrated management plan of coastal zone, should replace the preserved coastal area as well as the protected coastal area. Based on the idea of intergrated management plan of coast zone the whole legal system governing the preservation and the exploitation of coastal zone should be constructed.
