摘要

自2000年以返，台灣以漁業實體身份參與中西太平洋高度洄游魚類種群養護與管理公約。本文主要在於探討實體概念以及台灣之漁業實體的法律地位。此外，本文亦嘗試說明台灣如何參與前揭公約以及公約如何成為台灣內部法的法源而得以在內部法領域中被適用。最後，本文則說明公約中之執法規定應如何被適用。

Since 2000 Taiwan has participated in the Convention on the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean. This article examines the concept of entity and the legal status of Taiwan as a fishing entity. The article also examines the way Taiwan to be bound by the convention and the adoption of the convention in the domestic law sphere of Taiwan. Lastly, the article attempts to demonstrate how the enforcement regime of the convention should be applied by the authorities of Taiwan.
