歐盟跨國醫療照護制度之研究

摘要

歐盟會員國在不同的文化、政治與社會背景下，發展出各自不同的社會保障制度，在歐盟實現單一市場保障商品自由流通、人員自由遷徙、勞務自由流通與資金自由流通的目標下，在社會保障領域，隨著單一市場的完成，歐盟逐步的協調整合會員國彼此不同的社會保障制，而發展出一套歐盟的社會保障制度。隨著歐盟人員自由遷徙，健康方面的醫療照護需求也日益顯見，遂於數10年前即開始推展跨國醫療，端視歐洲跨國醫療照護保健制度的進展過程，毫無疑問，歐盟法院的判決，也發揮了主導歐盟的醫療照護保健政策歷史進展之影響力。本文著重於介紹歐盟的社會保障制度及跨國醫療照護制度的具體做法。藉彙整分析歐盟跨國醫療發展概況趨勢、運作模式與法規，期能提供臺灣國際醫療強化策略之借鏡。

Under different cultural, political and social backgrounds, EU member states have developed their own different social security systems. Under the EU's goal of ensuring the free circulation of goods, the free movement of people, the free flow of labor and the free flow of funds in the European Union, the single market is in the field of security. With the completion of the single market, the EU has gradually coordinated and integrated the different social security systems of its member states to develop a set of EU social security systems. With the free migration of EU personnel, the demand for health care has become increasingly apparent. Looking at the progress of the European transnational medical care and health care system, there is no doubt that the judgment of the European Court of Justice has also played a leading role in the historical progress of the European Union's medical care and health care policy. This article focuses on introducing the EU's social security system and the specific practices of the transnational medical care system.
