行政法理分析

本研究要旨是在探討行政法理論概念與法理精神，而事涉行政行為之作為機關為行政機關，而行政法理論與法理精神，主要是在於行政機關作成行政處分、締結行政契約、訂定法規命令與行政規則、確定行政計畫、實施行政指導及處理陳情等行為之程序，應遵循公正、公開與公民訓育民主之正義程序，確保依法行政之原則，以保障人民權益，提高行政效能，增進人民對行政之信賴。因此，行政法之基本概念，應符合比例原則、信賴保護原則、程序正義原則，以及福利國原則等概念，而福利國家之希望是行政法之目標，而福利國家之標的實現要有方法即法治的健全，所謂該抽稅該徵兵保國衛民，或法治成熟之有賴健全教育，一切在培養健全、普及的法治教育，多數人之公益大於私益，少數人之權益須被尊重等。

The realization of the rule of law have a method that is robust, the taxation of the so-called conscription to defend the country , or the rule of law have re improve education, all in perfect culture, rule of law universal education, the majority of people's welfare more than selfish, Interests of several people shall be respected.
