地方社會土地經營的「近代」經驗－以鳳山縣維新里為中心

臺灣歷史研究的脈絡中，地方社會往往是最難以捉摸的一個環節，或是憑著父祖、耆老對過往的追憶；或是依憑那少得可憐的文獻資料來理解，這些資料大部分是方志、采訪冊、文集、日本人彙編的統計數字，以及更多民間故事的傳奇演繹，地方社會經常是流於虛妄而單調的圖景意象。維新里是臺灣南部自明鄭時期至日治初期的一個行政區劃，其範圍即今高雄市的路竹區南部、岡山區西北部及永安區東部。本文試圖從20世紀前後公文類纂中的舊記書類中，梳理出地方社會遭遇「近代」的經驗，透過與地方性的還原將公文書載錄的多重語意資訊解析出來。這些經驗多是留存於行政體系編織合法性統治網絡的過程，有意無意間探知的地方社會的樣態；或是改朝換代過程中的異議喧鬧──土地爭訟、公私權利分化等訟案；或是求助官府裁決時地方社會所呈上紙面公文裡的話語。天高皇帝遠的喟嘆已然隨風而逝，「近代」經驗援引的法規如探針般試探著地方社會的日常生活，地方社會的多聲部話語更是如實紀錄這個過程，從這個對位關係的趨勢，或可還原出地方社會裡人地關係的歷史化過程。

The working of local society might be the most enigmatic conundrum of Taiwan history, that is, by reminiscence of the elder and rare records which could be local chronicles, custom interviews, literature collection, statistics surveyed by Japan and oral legends narrated by peasants, local society would be a fantastic and stereotyped scenery. Wei-xin-li area was an administrative district of the South of Taiwan from Ming-zheng era to the early of Japanese rule, today ranges between the South of Lu-zhu, the Northwest of Gang-shang and the East of Ueng-an of Kaohsiung. Taking the area for example, the article is to sort out the experience of local society confronting the modernity hidden in aged records, such as categorized official document compilation. These experiences mostly existed in the records to take note of governmental process of Japan rule or quarrel cases in the switching of two regimes which leaded to legal land disputes and differentiation of public and private privilege which appealed to official bureaus to judge. Regulation and law of the modern had been probing into the depth of local society, which is, the relationship between peasants and their lands of local society would be revealed while the peasant community meet and conflicted with the civilized modern. To trace the confronting and conflict might be a probable way to comprehend the puzzle conducted by local society in Taiwan history.
