摘要

還我土地是原住民族運動的核心訴求，然而，由於土地議題牽扯許多重大利益，原住民族土地的名稱與實質均有多樣化的面向，並引發不同的詮釋，而名稱的多樣性除了觀察論說角度的歧異，也具體表現原住民族土地問題的複雜度。本文試圖從時間、空間、倫理（權利與正義）、權力、文化與神聖、經濟等角度，思考原住民族土地的諸種面向，解析這些向度具有雙重的意義，一方面，可以釐清問題的本質，解構理解的藩籬；另一方面，則可完整呈現權利內涵，據以闡釋原住民族土地權的完整風貌，以批判現行原住民保留地制度，並作為建構原住族土地政策的基礎。

Land claim is the core demand of Indigenous Peoples' movement. The land issues not only involved many significant benefits, but lead to various interpretations. It also highlights the complexity of land issues. This article bases on diversity aspects which include in time, space, ethics, power, culture and sacred, economic to think indigenous land issues in Taiwan. On the one hand, this paper clarifies the nature of the problem, and deconstructs the barrier of understand; on the other hand this article presents the content of land right fully and criticizes the indigenous reservation land policy to reconstruct the Taiwan's indigenous land policy.
