族群主流化觀點下的原住民族轉型正義

Indigenous Peoples and Transitional Justice: An Ethnic Mainstreaming Perspective

摘要


面對原住民族轉型正義在定義與推動方式上的爭議,本文主張採取族群主流化的視角來討論。族群主流化意指讓各級政府部門具備基本的族群敏銳度,並讓社會大眾意識到每個人都是族群關係的當事人,進而促使多元族群都能共同參與社會主流的建構。由此,原住民族的轉型正義,應可理解為台灣脈絡下整體轉型正義工程特殊但最為重要的一環。據此,本文評價現有三類推動原住民族轉型正義的方案:若將原住民族轉型正義與威權時期轉型正義合併立法並成立單一專責機關,最有可能實現轉型正義企求的社會和解與穩固民主發展功能;反之,若切割原住民族轉型正義單獨立法,則社會需有更大能量與共識支持;至於落實『原住民族基本法』的說法,則不宜完全取代對原住民族轉型正義的思考。

Faced with the debate about the definition and strategy of the indigenous transitional justice, this article emphasized a perspective from ethnic mainstreaming. Ethnic Mainstreaming requires the government at all levels to have basic ethnic sensitivity and to raise the public awareness of that everyone is part of the ethnic relations, and then all ethnic groups would be able to participate in construction of the mainstream society. The indigenous issue is a special and significant part in transitional justice in the Taiwanese context. The present article assessed three indigenous transitional justice programs from the point of view of the ethnic mainstreaming to see if the merged legislation of indigenous transitional justice and authoritarian transitional justice could effectively achieve social reconciliation and democratic consolidations. On the contrary, if separating or even not making legislation for indigenous transitional justice will require more social consensus in order to bring reconciliation. It is incompatible with the general awareness of the transitional justice to consider the implementation of the Indigenous Peoples Basic Law being equivalent to the implementation of the indigenous transitional justice.
