摘要


本文分析『聯合國原住民族權利宣言』中知情同意權的可能解讀,並將之區分絕對論及條件論兩類詮釋觀點。進而介紹研究倫理中原住民族知情同意權制度之源起,及其於美國、加拿大之制度實踐。最後,再說明我國之制度實際概況,並據以分析研究倫理中原住民族知情同意權之制度實踐背後,如何蘊涵前述絕對論及條件論。

This study analyzes the possible interpretation of the right to free, prior, and informed consent (FPIC) in United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) and distinguishes it from two categories of interpretations: absolute and conditional. Furthermore, it introduces the origin of the system of informed consent of indigenous peoples in research ethics, and its institutional practice in the United States and Canada. Finally, it explains the current situation of Taiwan's system and analyzes the institutional practice of the indigenous right of FPIC in research ethics.
