論日本住宅品質確保促進法與住宅紛爭專門處理機制－對我國建立住宅性能評估制度之建議

日本住宅品質確保與住宅紛爭處理機制其規範目的、精神及做法與我國住宅法立法所欲達成之目標相符，且國情、社會條件各方面皆相類似，日本施行滿20年的經驗實具有參考價值。故本文建議政府有關部門於今後修法或規則制定上可參酌上述日本住宅品質確保與住宅紛爭專門處理機制之做法，建構我國住宅品質確保與住宅紛爭專門處理機制相關配套措施，鼓勵住宅之興建者或所有權人申請評估，以落實住宅法健全住宅市場，建立公平效率住宅補貼制度，規劃合宜社會住宅，提升居住品質，使全體國民居住於適宜之住宅且享有尊嚴之居住環境。

Japan's housing quality assurance and housing dispute settlement mechanism has a normative purpose, spirit, and practice that are consistent with the goals of Taiwan's Housing Law legislation, and are similar in all aspects of national conditions and social conditions. Japan's 20-year experience is of reference value. Therefore, this article recommends that relevant government departments may refer to the above-mentioned Japanese housing quality assurance and residential disputes special handling mechanism in the future amendment of laws or rules, and establish related supporting measures for Taiwan's housing quality assurance and residential disputes special handling mechanism to encourage the builders or the owner applies for evaluation to implement the housing law to improve the housing market, establish a fair and efficient housing subsidy system, plan suitable social housing, improve the quality of living, and make all citizens live in suitable housing and enjoy a dignified living environment.
