大陸《人民警察法》（修訂草案稿）評析
An Analysis of the Revised Draft of People's Police Law of the People's Republic of China
摘要
大陸的《人民警察法》係於1995年2月28日公布施行，其前身為1957年6月25日公布施行的《人民警察條例》，該法主要乃為規範人民警察與公安機關的綜合性法律。近年來隨著大陸公安制度的改革，公安部將修改《人民警察法》作為全面深化改革的重點專案，致力推動修法工作。並於2016年12月1日對外公告該法《修訂草案稿》，擬對這部法律進行較大幅度的修訂，未來影響深遠可期。本文乃以該法修訂草案稿為核心，首先從宏觀的角度分析《人民警察法》之法律性質，次就人民警察與公安機關之概念加以探討，再論警察任務主體與職權種類。另從微觀的角度，選擇修訂草案稿中有關警械使用、身分查證職權、預備警官制及警務輔助人員法制化等四項，被認為是值得關注點，或被稱為修法「亮點」者，逐一加以評析。文中並與臺灣的警察法制略作比較，最後再就該法修訂草案稿予以綜合評述。

People's Police Law of the People's Republic of China was promulgated on February 28, 1995. Its predecessor was the People's Police Regulation promulgated on June 25, 1957. The People's Police Law is a comprehensive act regulating the people's police and public security organs. In recent years, along with the reform of the public security system, the Ministry of Public Security considered the revision of the People's Police Law as an important project to further deepen the reform. ＂The Revised Draft＂ was announced on December 1, 2016. A significant amendment has been made to this law. It is expected that the amendment will bring about far reaching influence in the future. This article focused on ＂the Revised Draft＂. Firstly, analyzed the essence of the People's Police Law from a macro perspective. Secondly, discussed the concepts of the people's police and public security organs. Thirdly, probed the main body of police tasks and types of police authorities. Besides, based on a micro perspective, commented on four main points of ＂the Revised Draft＂: the use of police equipment, the right of identity check, the system of preparatory police officers, and the legalization of auxiliary police, which were regarded as the major concerns and were called the ＂highlights＂ of the revision. Finally, after comparing with Taiwan's Police Act, assessed ＂the Revised Draft＂ comprehensively.
