Cross-Strait Legal Coordination for Safeguarding the Rights and Interests in the South China Sea Based on the Common Political Foundation

摘要


The collaboration between the Cross-Strait on the South China Sea must deal with the relations between mutual political foundation and legal coordination. The collaboration should get on legal coordination according to modern international law, constitutional laws and internal regulations. The basis of international law for resolving the identity tension, mainly includes the common norm position in the South China Sea, China's Taiwan region's participation powers, and the divergence of international laws. Besides, laying the political foundation solid for "One China Including the Cross-Strait on the South China Sea Issue" as well as constructing legal norms centering on the Cross-Strait's fundamental law. Moreover, improving relevant approaches to harmonize normal and technical conflicts within the rule system on the South China Sea between the Cross-Strait, such as information mechanism, organization mechanism, authorization mechanism, procedure mechanism and negotiation mechanism.
