联合国人权理事会普遍定期审议中国家提出建议的影响因素分析

Analysis on Influencing Factors Driving Countries to Make Recommendations in Universal Periodic Review of UN Human Rights Council

摘要


在国际人权机制的发展进程中,联合国人权理事会普遍定期审议机制是国际人权治理中的重要制度创新。十余年来,三轮普遍定期审议中的国家互动呈现出复杂的面貌。既往研究对普遍定期审议机制中的国家建议多有关注,从中可以就普遍定期审议中国家提出建议的影响因素提出若干假设。这些假设涵盖建议提出方、国家之间的差异、受审议国自身三个方面的多重因素,可以依据大量人权指标和贸易、政体等数据以定量统计的方式进行验证,进而可以运用一种关键词分类法探究区域因素对国家在机制中提出建议的影响。多重数据分析的结果证实,受审议国的人权状况是成员国在审议中提出建议的主要影响因素。另外,区域因素对国家参与行为的影响也得到了证实。

In the development process of international human rights mechanism, Universal Periodic Review (UPR) of UN Human Rights Council is an important institutional innovation in international human rights governance. For more than a decade, states' interactions in the three UPR cycles have taken on a complex face. Previous studies have paid much attention to states' recommendations in the UPR mechanism, from which several hypotheses can be formulated regarding the influencing factors of states' recommendations during the UPR. These hypotheses, which cover multiple factors in terms of recommendation making states, differences between states, and states under review themselves, can be verified in a quantitative statistical manner based on a large number of human rights indicators and data on trade and form of government. Furthermore, a keyword classification method can be applied to explore the influence of regional factors on the states' recommendations in the UPR. The results of the multiple data analysis confirm that the human rights situation in the state under review is the main factor influencing the recommendations made by member states in the review. In addition, the influence of regional factors (regional organizations & regional groups) on states' participation behavior has also been confirmed.
