檢視台灣地區農業用水之水權－以桃園水利會水權登記為例

由於經濟發展及社會環境變遷，各標的用水需求甚殷，又因各標的間存有衝突之關係，如何使各用水部門間水資源適當調配，實為政府施政之重要課題。農業生產之經濟效益雖遠不如工業，但在考量國家糧食安全性及農業對生活機能與生態環境維護的情況，政府不能僅以經濟效益作為建立制度依據的思考方式應是顯而易見的。本文以桃園水利會在石門水庫水權重登記之案例，檢視相關單位對農業水權之作為。在兼顧生態保育與經濟發展的過程中，本研究倡議在分配水資源及徵收水權費時，除了參考國內法規與國外案例外，亦須尊重已獲得水權者法律所賦予之尊嚴，及其遭受轉移、變更時所應給予之補償，以避免可能發生之偏誤，使農業用水資源能促進農業永續發展之願景。

The growing demands for expanded supplies of good quality water for human consumptions, as well as ecological and industrial use are receiving great attention recently. In the process of satisfying these expansions, the government proposes the water right management project. However the conflict is highly raising between agricultural and industrial uses. In this study, we examine the water right of agriculture in Taiwan. A recently case of Tao-Yuan irrigation association on registering water right affair is reported. The agricultural water right would greatly reduced under the circumstance. To avoid unjustice and any unnecessary bias in dealing with water right issue, we emphasis that the hydraulic law and historical water right must be fully respected and our ecosystem and economic development should be put on equal basis.
