我國解嚴後罷免運動與罷免制度之研究

摘要


我國乃世界上少數同時採行公職人員、立法委員與總統副總統罷免制度的國家,而罷免制度運行至今,也產生了相當多的爭議以及大型的社會運動,並造成我國政治板塊因而產生劇烈的變動,甚而導致政黨輪替。 本文將探討我國選舉罷免制度中有關「罷免」部份之演變,並將結合解嚴後之幾大指標性之罷免運動:(1)1994年第二屆台北縣立法委員林志嘉、洪秀柱、韓國瑜、詹裕仁罷免案(2)2000年及2006年陳水扁總統罷免案(3)2013年立委吳育昇罷免案(4)2014年立委蔡正元罷免案暨「割闌尾計畫」運動等為例,另附帶補充近期的立法委員黃國昌罷免運動,說明我國目前罷免制度的結構性問題,並探討未來進一步之修法方向。 本文認為罷免制度於我國適用之結果基本上算是正面的,雖然歷經了1994年之不合理修法而大幅提高罷免門檻,而在歷經政權輪替後,終於在2016年11月29日將罷免制度作了大幅度的修正,使門檻得以合理化,而罷免在我國運行的結果也促使選民能夠更加關注公眾議題,進而促進重大政策的進一步討論,使得我國民主得以更加深化,故本文是贊成繼續維持罷免制度的。 另未來修法的部分,本文認為應該對於罷免的理由要設定一定的門檻、總統罷免部分於全國人民投票部分的門檻應也要適當調降、最後立委部分的罷免門檻因為已修正為單選區兩票制,應也要研擬修正。

R.O.C. is one of the few countries in the world that can recall public officials, legislators and presidential vice presidents. At the same time, the recall system has generated quite a lot of controversy and large-scale social movements, which has resulted in politic violent change, and even lead to political rotation. This article will discuss the evolution of the "recall" part of the electoral removal system in R.O.C., and will combine several major indicators of recall after the lifting of the campaign: (1) The second Taipei County Legislators Recall in 1994 (2) Recall of president Chen Shui-bian in 2000 and 2006 (3) Recall of Wu Yu-sheng from the Legislature in 2013 (4) Recall of Tsai Chien-yuan from the Legislature in 2014 and the "Cut-appendix Program" campaign, and also supplemented by the recent legislator Huang Guochang recall campaign, then explain our current structural problems of the recall system, and explore the future direction of further revision. This article argues that the recall system in R.O.C. is basically a positive result, although after 1994, unreasonable amendment to substantially increase the recall threshold, and after the rotation in power, and finally, the recall system of 29 November 2016 has been substantially amended to rationalize the threshold, and the results of the recall in our country have also prompted voters to pay more attention to public issues, thereby promoting further discussion of major policies, enabling our democracy to more deepening, so this article is in favor of continuing to maintain the recall system. The other part of the amendment to the law, this article that the reasons for the recall should be set a certain threshold, the presidential recall part of the citizen people to vote part of the threshold should also be appropriate to lower, and the legislator of the recall threshold has been amended as a single electoral district two vote system, should also be developed to amend.
