我國政風機構功能之研究

摘要


我國政風機構是民國81年由原先設置在政府機關內的保防單位改制而來,成為我國廉政體系的一根支柱。由於立法策略的疏略,至今雖然卓有績效,卻沒有得到應有的肯定。雖然廉能的政府是全民的期待,每一位首長也都信誓旦旦的要致力廉政建設;但是,政府組織再造的過程中,在各機關無所不用其極地爭取員額時,政風機構顯然沒有得到應有的組織規模與員額,甚至淪為犧牲。 本文針對政風機構主要的三項業務:預防工作、查處工作與維護工作,具體地對其本質意義與現況的困結提出檢討,並提出建議。 政風工作是行政管理工作的一環。預防工作須以「與人為善」為本;不同的機關會有不同的問題,顯示政風工作的在地性。查處工作的關鍵是法定的行政調查權;對人的處分與對事的決策是首長的職權,政風機構應善盡幕僚的職責並謹守幕僚的分際;但「刑事責任」的舉發是法定的責任與義務,非任何人所能干預。維護工作是國家安全工作的一環不能逃避,須明確的訂定法規作為依據,及明確的組織與分工才能期以妥善執行。 預防、查處與維護的共通點是「察覺問題並敘明問題」,如此,才可能加以管理或提出改善方案;此則必需累積相關的知識與經驗。政風人員須勤於學習所在機關的專業知識,政風機構應建構知識管理。 政風機構想要跳脫「佈置在機關中的內線」的角色安排,改變疏離處境,必須守住幕僚單位的角色,為機關設立的目的服務;同時,我們可以用現有的職權與工作方法,建構自己的論述與績效策略:用自己的策略思維、拿出自己的產品,針對不同的「顧客」作不同的行銷。 依法行政,所以修法是必要的手段與必經的過程。建議在「政風機構人員設置管理條例」中,關於政風機構掌理事項加上調查,即「機關有關之貪瀆與不法事項之『調查』處理」;以及增加「機關安全維護之處理及協調」工作;並訂定「政風機構人員職權行使法」作為規範。 從政策執行的角度來看,一個公共政策它的本質跟他最後的成敗、好壞,取決於政策制定後的諸多決策與作為;廉政建設在制度面尤其是政風機構的組織系統與員額編制仍待檢討。我們確信,人們有向善求好的意志,廉政不會淪為口號或空談。

The government ethics departments of our country were first set up as parts of the security divisions of the government in 1992 and then restructured into becoming the backbone of the system against corruption in our country. Due to the neglect of legislative strategies, proper affirmation has never been given contrary to the effective performances to this day. People expect an honest and capable government and every one of the senior officers solemnly pledge to devote to the establishment of a government against corruption. Yet in the process the re-organization of the government, each department stops at nothing to fight for the specific number of personnel. The government ethics departments evidently didn’t receive the deserved size of organization or specific number of personnel, even declining so far as being given up. This paper will be directed at the three main functions of the government ethics departments: prevention works, investigation works, and maintenance works. Concrete examinations and suggestions will be given with regard to the essential meanings and the difficulties in the current situation. Government ethics works are a part of administrative management. Prevention works must be done with the fundamental principle of “for the good of others”. Different departments have their own different brand of problems, and this demonstrates the localization needed for government ethics works. The key to investigation works is the right of enquiry under the law. Senior officers have the power to take disciplinary actions against people and to make the decisions, while the government ethics departments should fulfill and keep to the duty of advisors. But to expose “Criminal Responsibility” is a legal responsibility and obligation, not be intervened by anyone. Maintenance works are an important link to national security details, which must operate according to clearly designated regulations and have clear-cut organization as well as cooperation to execute properly. Prevention, investigation, and maintenance all have one common cause, which is “to discover and to give detailed accounts of the problem”, and that’s the way to manage or provide improvement methods. Accumulation of related knowledge and experience is needed. Government ethics officers must strive to learn professional knowledge, and the government ethics departments should work on knowledge management. Government ethics departments should keep to the advisor unit role and serve the purpose of the department in order to escape the “planted within departments” role placement and to change being distanced from circumstance. Simultaneously, we can use the current functions and work methods to build our own discourse and performance result strategies: make use of our own strategic thinking abilities, take out our own products, direct different ways of marketing tailored to the different “clients”. All administrative executions are according to law, so changing the laws is a necessary means and inevitable process. I suggest that in “Act of the Establishment and Management of the Government Employee Ethics Units and Officers” , investigation be added to the list of items under the administer of government ethics departments, meaning “ the power of investigation in regard to the corruption and illegally circumstances in the government ”. I also suggest to add the work detail of “Law of Governing Ethics Department`s power”, and to make “Law of Governing Ethics Department`s power” as the standard. From the angle of implementing policies, the nature of a public policy and its success or failure, effectiveness or ineffectiveness are decided by the many decisions and accomplishments after said policy is set up. The construction of a government against corruption still has much room for improvement in the system prospect, especially the organization and personnel number authorization of the government ethics departments. We have confidence in the will of the people to strive for goodness, and that a government against corruption isn’t just a slogan or empty talk.
