論我國企業如何因應美國專利訴訟進行訴訟管理- 以證據開示程序為中心

美國專利訴訟無論是在規模、程序以及費用上都與台灣專利訴訟屬不同的層級。此外，在美國提出專利訴訟更多的時候其背後的目的更是為了競爭以及取得市場。因此在市場越來越競爭且我國企業還是要繼續進行國際貿易的情況下，熟悉相關的訴訟程序才不會淪為制度下的敗將。除了需要熟悉此種相關程序以外，企業還需要進一步知道如何系統性以及全面性地管理美國專利訴訟的範疇以及費用。本論文的撰寫主軸在於整理美國訴訟中費用最為高昂的證據開示程序的相關規定，希冀透過限制證據開示的範疇的方式達到訴訟範疇以及費用的管控。且，本論文第伍章透過訪談的方式了解企業目前因應美國專利訴訟以及公司內部管理的方式，並歸納整理出幾點建議供我國企業參考，讓我國企業面對之後的美國專利訴訟能夠更能夠掌控並奪回主導權。

Patent litigations in United State are different from Taiwan patent litigation no matter in scale, in procedure or in cost. Nowadays, patent litigations not only are used as a mean for competition but also to gain the market share or a weapon to force the competitor out of the market. If Taiwan’s cooperation would like to keep active and transaction globally, Taiwan’s cooperation should have to be more familiar with US patent litigation. Otherwise, the cooperation might be facing more legal risk and be beaten in this system. Therefore, how to systematic and fully manage the scope and cost of the litigation would be a need. One of the objections of this thesis would be summarizing the procedures and the regulations of discovery procedures in patent litigation. In order to manage the litigation, the cooperation should be familiar with the procedure of the discovery. In the penultimate chapter of thesis also interview some cooperation in order to understand how cooperation manage US litigation. In the final chapter of this thesis provides some suggestions for the cooperation to deal with future litigation and a better management of the litigation.
