銀行保代之簽署人定位及制度探討

摘要


保險簽署人制度存在已久,隨著銀行業者開放兼營,其業務規模日漸擴大,並受主管機關高度監理,但在實務作業上,簽署人制度存在檢討與改進的空間,期許能透過法令的修正,讓其更符合實務作業,並使實際銷售之業務員能夠進而承擔其該承擔之責任,進而替客戶做更完善的規劃。 本研究依據參考文獻及探討業界實務經驗得到以下結果: 一、銀行之簽署人需逐案親自簽署保險案件,該項作業似無絕對地必要性,應適時調整或修正,或廢除保險代理人簽署制度。 二、「保險代理人管理規則」中規範簽署人所需負擔之責任與義務,經本研究之探討,其部分乃可由銀行及保險公司之制度所取代。 三、法令要求簽署人需「了解客戶需求及商品適合度」,但業務員乃為實際招攬保 險之人,為接觸客戶之第一線人員,本需確實了解客戶之需求,以提供客戶最適當之保險商品,故本研究認為該義務需改由實際銷售保險之業務員來承擔。

The insurance of signatory system has been in existence for a long time. With the opening of Insurance Agent in Banks operate concurrently, the scale of business has gradually expanded, and they are highly supervised by the competent authorities. However, in practice, there is existed space for review and improvement of the signatory system. Amend it to make it more in line with practical operations, and enable the salesperson who actually sells can take on the responsibilities that they should undertake, so as to make better planning for customers.   Based on the references and discussing the practical experience of the industry, this study obtained the following results: 1.The signatories of the bank shall personally sign the insurance case on a case-by-case basis. This operation does not seem to be absolutely necessary and should be adjusted or amended in due course, or abolish the signature system of insurance agents. 2.The Insurance Agent Management Rules regulates the responsibilities and obligations of the signatories. After the discussion in this study, some of them can be replaced by the systems of banks and insurance companies. 3.The law requires signatories to "understand customer needs and product suitability", but the salesperson is the person who actually sell insurance. As the first-line personnel in contact with customers, they should really understand the needs of customers in order to provide customers with the most appropriate insurance product. Therefore, this study account that this obligation should be borne by the salesperson who actually sells the insurance.
