軍公教優惠存款制度之法律問題

摘要

第一章，為本文的緒論。
在第二章中，本文首先依時間的順序分別就軍公教人員優惠存款制度的由來以及內容來做一簡介，後來因時代的變遷使得退休軍公教人員優惠存款制度為人們所批評，因此銓敘部推動公務人員退休所得合理化改革方案，卻又導致軍公教人員提起訴訟以及國會的爭議。所以，本章藉由軍公教人員優惠存款制度的發展順序說明，以作為本文以下研究問題的開展。
第三章，依國內文獻與軍公教優惠存款相關法規範來就軍公教優惠存款制度中的相關法律關係，來了解減核優惠存款金額函性質為何？
在本文第四章，以法釋義學的方式，旨在以憲法的觀點，分別就「法律保留原則」、「平等性原則」、「比例原則」、「信賴保護原則」及「財產權保障」五個面向，再加上國內文獻與退休軍公教人員優惠存款制度中的法規範來探討軍公教人員優惠存款制度的合憲性與否，由於軍公教人員退休金優惠存款制度與軍公教人員保險養老給付優惠存款制度兩種制度設立的時間、法律之依據分別有所不同因此，將分別來探討。另外廢除或變更軍公教優惠存款制度是否侵害軍公教人員的信賴利益，因而違反憲法上的信賴保護原則與財產權保障。將在本章中詳加論述。
第五章為本文的結論，茲將本文各章節之重要部分以及研究結果，予以摘要總結與提出建議。

The first chapter is the exordium of the thesis
In the second chapter, the thesis first acquainted with the preferential interest rate on retiring deposit for military servants, civil servant and teachers by times, and the animadversion of the preferential interest rate on retiring deposit. So Minister of Civil Service advance a formula to innovate the preferential interest rate on retiring deposit, but solicit assumpsit by military servants, civil servant and teachers and parliament issue. Inasmuch, the interpretation of the preferential interest rate on retiring deposit for military servants, civil servant and teachers to start the following research issues in the thesis.
In third chapter, I analysis the issue of he preferential interest rate on retiring deposit for military servants, civil servant and teachers from the materials in Taiwan and affiliated enactment to acquainted with the abate preferential interest rate on retiring deposit action.
The main research issue of the fourth chapter ,by the law study of interpretation theory, I use constitutional angle, individually use Vorbehalt des Gesetzes, Equality Principle, principle of proportionality, the protection of reliance interest ,bulwark of property, and the materials in Taiwan to acquainted with the preferential interest rate on retiring deposit for military servants, civil servant and teachers is cohere with constitution. Aside from, abate and change the preferential interest rate on retiring deposit for military servants, civil servant and teachers whether attack their audience. Accordingly against constitutional the protection of reliance interest and bulwark of property. This chapter will particularly discourse.
The fifth chapter is the conclusion of this thesis. The substantial parts of each chapter and the result of this research will be summarized into conclusion, and advance instance.
