兩岸任意汽車責任保險條款之比較研究

隨著經濟不斷的發展，汽車已經逐漸成為人們日常生活中不可缺少的一部分，也因為汽車需求逐年增大，遭受交通事故造成人員傷亡以及財務上之損失金額也逐年提高，因此，汽車保險提供之保障也越來越受到汽車車主或管理者之關注。雖然強制汽車責任保險的目的在保護車禍中的受害者，但從保障的角度來看，僅投保強制汽車責任保險是無法完全補償受害者的損失，必須投保任意汽車責任保險來加強保障。本研究介紹台灣與大陸的保險沿革及發展，將兩岸的任意汽車責任保險主保險契約條款以及附加條款比較，分析兩岸的承保範圍、不保事項、被保險人之範圍、保險金額之約定方式、直接請求權、理賠範圍、複保險，以及一些其他重要條款，從中比較兩者保單及附加條款的相同處以及相異處，俾供兩岸學習彼此的優點，以作為未來在任意汽車責任保險條款修訂之參考。

With the continuous development of the economy, automobiles have gradually become an indispensable part of people’s daily lives. Because the demand for automobiles has been increasing year by year, the number of casualties and financial losses caused by traffic accidents has increased accordingly. Therefore, the protection of automobile insurance has been paid attention more and more by the owner or custodian of automobiles. Although the purpose of compulsory automobile liability insurance is to protect the victims of accidents, from the viewpoint of protection, only the compulsory automobile liability insurance is incapable of fully compensating the victim's losses. Insuring voluntary automobile liability insurance should be consider as a good way for additional protection of automobile liability risks. In this study, we introduce the establishment and development of automobile insurance in Taiwan and Mainland China. We compared the terms of the main policy and the endorsements or additional clauses of voluntary automobile liability insurance between Taiwan and Mainland China. The terms compared include coverages, exclusions, definition of insureds, limit of liability, payment of loss, right of direct claim, double insurance, and other importance conditions. We compared the similarities and dissimilarities of these two kinds of insurance policy terms between Taiwan and Mainland China, in order to learn each other’s advantages to improve the design of policy terms in the future.
