台灣的弱勢族群如何平反過往承受不義的遭遇?特別是牽涉到外國政府及跨國企業曾經施予的不公平對待。本文舉慰安婦及台灣美國無線電公司勞工為例,發現不同類別的弱勢族群議題會吸引不同性質的民間團體的關注與投入,在這些民間團體熱心的參與下,弱勢族群得以團結集體行動,透過社會運動的方式倡議訴求,並進而以訴訟手段聲索遲來的正義。在聲援弱勢族群追求正義的過程中,民間團體面臨角色的轉換與困境,以及政府對於不同弱勢族群議題處理態度上的差異等,弱勢族群要如何達成追求正義的目標?本文嘗試以代理人理論探討民間團體、弱勢族群及政府之間的互動關係,發現弱勢族群以集體訴訟爭取正義,無論失敗或成功,對整體社會均有正面效益及影響。
How could the social injustices created by foreign entities be redressed? This thesis demonstrates the long struggles comfort women (associated with Japanese government) and victims of the Radio Corporation of America (a multinational corporation) pollution incident went through for the goal of justice. Many civil groups have joined to mobilize social movements and collect resources needed to sustain the campaigns and judicial process. While the overall achievements are still subject to debate, it is meaningful to examine how these zealous civil groups successfully assumed their role of subrogation through gaining trust from the victims, cooperating with different groups with diverse interests, and engaging the governmental agencies which were reluctant to be involved in the beginning. A comparison of the strategies adopted, the transformation of their organizational structures, and the conflicts among actors between the two cases would contribute to the shaping of the altruistic principal-agent theory.
