政府採購法辦理公共工程執行程序探討-以委託技術服務為例
Discussion on the implementation of the Public works program of The Government Procurment Act-A case from Commissioned technical services
摘要
機關執行公共工程，首先必須委託專業規劃設計之建築師或技師，委託適宜的規劃、設計或監造者，將是影響工程品質執行之關鍵。公共工程基於公開、公平、公正之原則，須以政府採購法公開招標辦理委託規劃設計及監造技術服務之採購，如何在政府採購法執行程序架構下，委託專業的規劃設計者進而達到公共工程品質管理，是機關之重要課題。 政府為有效改善舊有採購制度所衍生之缺失與問題，經長時間研議訂定政府採購法，惟本法實施至今尚有招標程序、品質管理及履約爭議等執行疑慮，顯示本制度仍存有應檢討及改善之問題。 本文以國內政府採購法辦理委託技術服務執行程序為研究範圍，以誘導式結構理論操作方法，並採文獻探討法、案例研究法及訪談法探討本制度執行所產生之效益及問題，並提出具體執行策略改善方向，透過該制度的執行吸引優秀規劃設計及監造人才投入，進而提升公共工程之服務品質及效率。

Authority to perform public works, we must first commissioned architects or engineers of professional planning and design, commissioned by appropriate planning, design, supervision, will affect the implementation of the project quality. Public works is based on the principle of an open, fair, and equitable public tender to the Government Procurement Act apply for Planning, Design and procurement of technical services supervisor, how commissioned professional planners and designers thus achieving public works in the framework of the implementation of the program of the Government Procurement Law, quality management is an important issue for authorities. Government to effectively improve the old procurement system derived from the lack and problems, deliberated for a long time to set the Government Procurement Law, provided that the enactment of this Act so far there are lack of tendering procedures, quality management and performance concems, shows the system stillshould review and improve the problem. Domestic government procurement law to handle technical commissioned service execution for the scope of the study the induced structure theory methods of operation, and uses literature analysis, case studies, and interviews to explore the benefits and problems arising in the implementation of the system, and to make specificimplementation of strategies to improve the direction to attract the best planning, through the implementation of the system design and construction supervision of personnel input, and thus enhance the service quality and efficiency of public works.
