「菸害防制法」新法,於2009年1月11日正式施行。新修正之菸害防制法在2009年實施後,為保障民眾健康相關規定與罰則皆加重,其中包括禁菸場所擴大:如室內外空間與三人以上室內工作場所全面禁菸等。而本研究目的在瞭解台灣主要報紙宣導2009年菸害防制法實質訊息內容與形式上訊息呈現方式,並進行系統性量化分析相關新聞之露出,進行報導數量、新聞議題、報導內容、報導方式與法令宣導正確性分析。 本研究利用內容分析法針對2007年6月1日至2009年5月31日,國內三大報紙聯合報、蘋果日報、自由時報,蒐集有關「2009年菸害防制法」相關新聞,共計498則為研究樣本。 研究發現整體報導數量以(1)2009年法令實施當月(97.7%)為最高峰,(2)議題內容多以各公、私立團體對於新法所發表相關政策(48.2%)為新聞重點;(3)寫作方式以純淨新聞(89.2%)為主;版面部分,則以地方新聞版面(47.0%)為主;(4)引用之消息來源多以政府單位、公營事業官員或相關人士(67.3%)為採訪對象;(5)報導語氣以中立,無任何意見闡訴(34.3%)居多;(6)菸害防制法宣導則以第15條(61.0%)全面禁菸場所為主,而該法條內容引用錯誤率達一成(10.9%),另在第26、28條宣導錯誤率(31.3%)則達三成。 本研究發現部分法令宣導錯誤率偏高,建議主管機關未來面對相關法令與政策宣導需建立媒體監看機制,尤其對於報紙報導錯誤需立即提出更正說明,以利閱聽者正確瞭解該法令,避免糾紛。
2009 The new no-smoking law, which became effective in January, 2009, applies to nearly all enclosed public and work places. It also applies most educational and health facilities, regardless of their indoor or outdoor spaces. No designated smoking rooms are allowed in work places, however in work places with less than 3 workers, smoking is not banned. In Taiwan newspapers are regarded as one of the most important sources of smoking message for the audiences, what issues have been reported and how such news were constructed remain under-explored. In this paper, we performed content analysis on 498 articles related to Tobacco Hazards Prevention Act in the three main Newspapers from 1 June 2007 through 31 May 2009. The results show as follows: (1) The number of tobacco articles varied considerably in different years, from a peak in 1997, the year the Law of Smoking prevention was carried out. (2) “News-directed” articles were dominant type of smoking related news, and (3) The most frequent theme was “tobacco legislation” and “anti-smoking campaign”. (4) Government officials were quoted significantly more often in the news(67.3 %). And 47.0 % of the news articles were located in the national or local news section. (5) 34.3 % of the news articles were neutral, (6) When news articles report The Tobacco Hazards Prevention Act article 15, (61.0%) primarily report banning smoking place, but misrepresent the Act 10.9% of the time. And the article 26, and 28, discussing fines, is reported incorrectly 31.3%. This research is high regarding the law misrepresents, suggest the government organization must establish a mechanism to monitor and correct mispresented Tobacco Hazards Prevention Act news articles. Especially, incorrect newspaper reports, should be corrected immediately, in order to help readers understand this law correctly and avoid disputes.
