本論文研製之「我國少年矯正學校辦學成效之評估研究-以誠正中學為例」,旨在探討我國執行感化教育的少年矯正學校-誠正中學,其已成立六年多,對國高中(職)階段學生之犯罪者,施以適當之矯治處遇,使其改悔向上之辦學成效。本研究的主要目的有下列幾項: 探討其:(一)運作方式是否達到矯正學校設置的目標、(二)校務執行的成本效益比率情形、(三)去標籤化下學生出校學籍銜接成效及問題、(四)出校少年再犯率、出校後就學、就業等復歸成效(五)技能訓練的成果、(六)外界的評價及認同度等;並根據研究結果提出具體建議,以供實務運作之參考,並提供未來修法之參考建言或可供日後修改少事法時之參考意見。 本研究流程首先係就少年事件保護處分之相關文獻回顧、及辦學成效評估之文獻探討,發展出本研究架構,再以實際參與觀察並蒐集相關個案學校的實務資料,及對該校教職員工採問卷調查分析,並實施部分教職員與熟悉少年矯正學校運作人士的深度訪談探討。 研究結論如下: 1.六年平均再犯率13.7%,比92年全國所公佈的27.04還低。2.六年平均佔總出校學生的比率:就學25.2%、就業38.9%。3.出校學生學籍轉銜總人數已逾千人。4.學生參加丙級技術士技能檢定,已有188人順利取得證照。5.一個學生一年半約平均花費約750,000元,在特殊教育的支出上雖較高,但今日的少年犯不予矯治可能將成為明日的成年犯,其所花費的社會成本更將難以估計,少年矯正學校經費支出的成本效益比率,若以長期宏觀的角度衡量之,此支出實屬必要與值得的。6.該校為我國首創執行感化教育之學校,外界的認同度高與好的執行評價,則我國在保護處分對犯罪少年或虞犯少年之處遇方式上,也將再往前邁進一大步。
The dissertation “A Study on Evaluation of Taiwan’s Juvenile Correctional Institutions (JCI) Performance – taking Chen-Jheng High School as an Example” aims to explore the performance of the juvenile correctional institutions in Taiwan – to demonstrate with the real cases of Chen-Jheng High School, which has operated for over six years since its establishment and provided proper corrective treatments and programs to juvenile delinquents aged twelve years and older (the junior and senior high school student age group). Furthermore the study targets the following objectives: To explore: (1) if its operational pattern meets the goals of a JCI establishment, (2) its programs implementation cost-benefit ratio, (3) its academic record continuation or integration achievements and problems in the juvenile delinquents /students leaving JCI under the “delabelization” policy, (4) its restoration performance in the youth leaving JCI including: delinquency recurrence ratio, school returning ratio and employment ratio, (5) its performance in the Life Work program – career skill training, (6) its external critiques and approval ratio. The study further presents substantial suggestions based on the research results with reference to practical implementations and also as constructive opinions on upcoming legislative amendments in particular those on juvenile delinquency law. The study begins with a literature review on juvenile delinquent protection measures and on the said JCI programs’ performance evaluation to develop the research framework; secondly, there is an investigation of the performance of the said JCI by practically examining and collecting the data of its practical implementations and by conducting a questionnaire survey to its teachers and JCI officers and conducting in-depth interviews with some of the said teachers and officers and researchers who are familiar with JCI implementations. The study comes to the following conclusions: 1. the Average Delinquency Recurrence Ratio in six years, 13.7%, reads lower than, 27.04%, the ratio of the 2003 Annual National statistical record; 2. the key youth average ratios of the said JCI read: school returning ratio 25.5% and employment ratio 38.9%; 3. the number of youth leaving the JCI and successfully returning to school reads 1,000 plus students in total; 4. the number of youth enrolled in the JCI winning Technician Grade C of National Vocational Qualification Examination reads 188 students; 5. in terms of cost-benefit ratio, the average cost per JCI student reading NT$750,000 is believed to be necessary and worthy – as interpreted from a macroscopic long term view on the cost-benefit ratio of the JCI expenditures. Although the cost spent in special education programs looks rather high it is actually low when compared with the inevitable social cost resulting from the coming adult criminals who today’s juvenile delinquents would become without being given the opportunities of correctional programs; 6. the said JCI, Chen-Jheng High School, as the very first juvenile correctional institution in Taiwan, plays a key role in the area of juvenile correctional measures and apparently a high approval rate and positive evaluation results to the said JCI will enable Taiwan to make a big step ahead in the rehabilitation of juvenile delinquents or adolescents with a high probability of committing crimes.
