探討民間參與公共建設案之經營模式與評估

摘要

受到英國與美國的施政方針的影響，再加上經濟條件所驅使，使得自由化的市場機制與委外民營現象成為世界的潮流。我國近年來也隨著這波潮流，逐步的邁向所謂的「民營化」，像是國營事業民營化，政府業務委外經營，以及民間參與公共建設等皆為民營化的範例。其中民間參與公共建設已經成為國內重要的施政方針，有助於解決「蚊子館」的問題。因此本研究希望深入了解促參案件的經營模式、營運困難並評估其績效，為未來的民間參與公共建設案件提供指引方針。
針對民營化、公司合夥、民間參與公共建設與經營模式等相關文獻進行回顧之後，整理出本研究的經營模式組成要素，並且針對三家不同領域的促參案件進行經營模式的個案訪談，希望深入了其經營模式，並提供解決問題的機制。另外，於第五章獨立探討不完整契約模型，基於文獻、台灣現況，修正不完整契約模型，使其更能解釋我國促參案件的狀況，並於第五章最末節應用模型，針對兩家促參案件進行效用分析。
個案訪談的部分歸納出以下建議：(1)簡化公文流程；(2)政府應針對個案特色與本質，以制定出合適的規範與簽約條件；(3)政府應該平均分配中央、地方資源；(4)推廣BOT促參案件，提升品質效率。修正後的不完整契約模型推論BOT案件的品質效率比OT(租貸)、補貼(管理契約)好，與第四項個案研究建議共同支持未來應持續推展BOT案件。應用模型進行效用分析後，提出下列建議：(1)政府應設法提高參與公共建設的民間機構的效用；(2)民間機構應該更重視品質的議題；(3)政府應該審慎進行促參案的可行性評估。

Because of both the policy of America and England and economic conditions, more and more countries depend on market power and privatization.So does our country, private participation in infrastructure projects is our main policy, and it can help us to solve problem of “Mosquito premises”. This research aim at learning business model of private participation in infrastructure projects, difficults of operation, and evaluate the performance to provide suggestion.
Review literature about “privization”,“private participation in Infrastructure”and “Business Model”, and develope our business model. Explore the business model of three target cases which belong to Private participation in infrastructure projects by case study, and resolve their operation problems. In chapter 5, we indenpendently explore incomplete contract model, and revise the model base on literature review and facts in Taiwan to explain the situations in Taiwan more correctly.Prossess the utility anlysis for two cases by using the revising model.
Case study suggest: 1.Simplify prossessing governmental.2.Government should make proper rules for given cases base on their nature.3.Fairly allocate resources between central and local government.4.Promote BOT projects. Revising model suggests the performance of BOT is better than OT and management contract. Utility analysis suggests: 1. Government should provide high utility to private company.2. Private company should emphasize on quality.3. Emphasize on feasibility evaluation.
