著作權法制與台灣文化藝術發展連動關係之探討

摘要


在智慧財產權的法制中,著作權法是與文化藝術發展最相關的法律。但當我 們重新檢視著作權法制的立法過程時,不難發現台灣的著作權法制係在著作權意 識尚未自然發生時即將西方的著作權體系移植進入,尤其深受中美經貿談判的壓 力所牽引,由此亦可得知著作權法的更修頻繁自與社會、經濟、文化、科技與政 治背景產生連動影響,並從中發現「文化霸權」亦出現在著作權法制化的過程中, 由是台灣主體性問題亦在此浮現。而在全球化的時代,若要台灣主體性的彰顯不 致淪於空談,文化權是必須被提倡的,此即本論文探討的重點。首先,第一章係 以研究動機目的、研究方法與文獻探索為緒論;第二章則探討著作權及其發展, 包括權利的本質、著作權法的起源、特徵與全球化的發展,並由著作權在台灣的 發展中提出霸權現象與台灣主體性的問題,再由此帶出文化權的意涵;第三章延 續討論文化權及其發展,除以文化政策觀察台灣的文化權發展脈絡之外,亦論及 文化產業與文化全球化的問題,其中特以法國「文化例外」為例,作為兼顧國際 著作權發展潮流與保護文化主體的觀察與省思;第四章係將戰後著作權法制與台 灣文化藝術發展的連動關係藉由法制面、文化面與經濟面的切入,點繪其中的連 動關係,再從連動關係的發展中,參照訪談對象的建議,並納入消費文化觀點以 及後殖民的觀點提出反思。最後於第五章總結全文並提出相關建議,以作為後續 研究之參考。

This thesis contains five chapters. Chapter one introduces motivations, objectives, methods and literature of this research. Chapter two studies the development of copyright, including the essence of the right, the origin, characteristics and global movements of copyright law. Through the study of copyright evolution in Taiwan, the author points out the issues of cultural hegemony and subjectivity of Taiwan and the concept of culture right. The culture right and it's development will be further discussed in the chapter three. Next to observing the culture right through the varied cultural policies in Taiwan, cultural industries and globalization of culture are also discussed in this chapter. French "exception culturelle" movement has been given as an example for taking into account both international trend of copyright and cultural subjectivity protection. Chapter four investigates the correlation between post-war copyright legislation and the development of culture and arts in Taiwan. Firstly, the correlation will be described from political, cultural, and economic perspectives.Then, the points of view of copyright-related persons in Taiwan, with whom the author has interviewed, together with the consuming culture and post-colonial perspectives will be also taken into account.Finally, chapter five concludes this research and provides some meaningful suggestions for future references related to the legislation of copyright and the policy-making of cultural development.
