台灣基督教浸信會法人立案與組織運作之 研究
A Study of Taiwan Baptist Church's Juristic Person Registration and its Organizational Operation
摘要
摘 要 本研究針對台灣基督教浸信會法人立案與組織運作為研究範圍。教會依宗教業務財團法人設立許可事項申請時，教會的態度應是已知法條內容且願意遵守規範下向申請政府立案。就法律面而言董事會（董事）/理事會（理事）權責清楚明瞭；然而落實在教 會執事面，因著教會教義與傳統，以執事會為決策主體，董事會（董事）/理事會（理事）似乎在教會有意或無意間弱化或架空法律賦予之權責。期間教會迭有相關之法律訴訟因董事會、執事會、牧者定位問題不清，權利義務各有解讀，徒生困擾。 筆者以最新的資料、相關文獻、期刊、法令規定、行政命令、網路資料、浸信會歷史資料及個案資料做研究來源，祈使研究結論，能提供敎會在政府立案過程中及立案後運作情形及政府與敎會的互動中政府需要明白現行法人立案制度對於宗教團體所造成 的影響能降至最低，另教會也需要明白，遵守法令是教會（基督徒）應盡的社會責任，在制度上若有法令適法上的疑義，教會亦應主動為願意服事上帝的弟兄姐妹，尋找適法的方法，期盼能喚起教會能重視此問題，並用積極的態度思考解決因應之道。

Abstract This study is to research on Juristic Person Registration and Organization Operation of Taiwan Baptist Church. The Church has to comply with the given criterion to apply from the government for the registration. Legally, the authority and responsibility of Board of Trustees or Board of Directors was stated clearly, however, when it is being practiced in the dimension of church service, due to the Church doctrine and tradition, as deacon committee is the subject of decision, Board of Trustees or Board of Directors in church might intentionally, or not, weaken or virtualized the authority and responsibility given by the law. In that time being, churches often being nterrupted by the lawsuit due to the problem where positioning of Board of directors, deacons committee and pastors was confusing, power and obligation being interpreted in each manner, which then causing problems. The author adopts the latest materials, ocuments, periodicals, laws, administrative orders, internet information, Baptist history and cases for the source of research. Hopefully the result of this research might provide the picture for the registration procedure of Christian religion from the government, and the relative working procedure after registration. In interaction of government and church, government should understand the effect that might caused by the current process of Juristic Person Registration for the religious community, and minimize it to the optimal, on the other hand, churches should also understand, obeying rules is the social responsibility of Church (Christian) should take. If there is any unclear on the rules and regulation, churches should take the initiative to find the suitable law for those brethren and sister who willing to serve God, and hope that Church could taking serious on this issue, and think the solution to address this issue initiatively.
