隨著現代交易方式日新月異,網路交易已經逐漸成為主流,然而業者標價錯誤之案例卻時有所聞,故本文欲分析網路交易標價錯誤所涉及的法律問題,將分成幾個層面探討:一、網頁標價之性質為何,係要約抑或是要約之引誘;二、自動回覆信函的法律性質為何;三、業者得否撤銷其標價錯誤之意思表示;四、消費者得否受信賴利益之保護。 而就「零售業等網路交易定型化契約應記載及不得記載事項」第5點修正案通過,來談及對於我國網路購物業者以及消費者之影響,此次修正是否已解決過去實務中標價錯誤常發生之爭議?本文希望能分別探討之並輔以實務上法院之相關標價錯誤判決為分析,了解現行法規上的不足之處,除了經典的戴爾電腦標錯價格案外,亦整理了2011年後標價錯誤案判決中有提及「零售業等網路交易定型化契約記載事項」之案例,以了解實務上法院判決是否有受到該記載事項規定之影響,最後提出本文結論。
Network transaction is getting bigger with development of technology, however the disputes of pricing mistake have been heard behind the news and matters. This thesis want to discuss the price on webpage of network transaction is “an offer” or an “invitation to offer”? Then discusses when the requirements of contract formation for online shopping and if the automatic replying message or email is merely a receipt notification or an acceptance by business owner? Can the network sellers claim dismissal the mistakes to be revoked if the contracts have been established? Could customers be protected by reliance interests? An amendment to “Official Announcement of Mandatory and Prohibitory Provisions Governing Standardized Contracts for the Retail Network Transaction” is Issued and Implemented by Ministry of Economic Affairs on July 1, 2016. What the impact on consumers and the business owner?. Is this amendment can solve above issues? This article focuses on above issues by analyzing and comparing related Taiwanese court decisions and to know the insufficient of current statute. This thesis includes case brief for online pricing mistake cases that including Dell and the court decisions after 2011 what have mentioned about “Mandatory and Prohibitory Provisions Governing Standardized Contracts for the Retail Network Transaction” went into effect and then analyze whether this provision impacts Taiwanese court opinion. In the end of this thesis is the conclusion.
