摘要


在現今社會,日常生活中許多事情都會與公證有關,常見如出生證明、公證結婚及遺囑等,到商業市場中的金錢借貸、合約公證、不動產買賣,都有機會可進行公證,公證之效力是協助當事人預防紛爭、保全相關證據,使相關文件之效力獲得確認,但對於合約及證據文件等原創性與時效性認證需求日益廣大,多數仰賴民間第三方認證單位,如民間公證人事務所等,但此等程序繁瑣費時且費用不貲,加上雙方請求人及公證人需留存合約紙本並加以保存管理,對日後原創性與時效時性舉證,亦是困難重重,又如何有效率地保存原創資料紀錄並且公開、公證的方式? 本研究主要利用區塊鏈 (Blockchain) 技術的計算可信性、價值可信性、數據可信性、方法可信性、系統可信性等特性,將存證的合約紙本加以數位化後,數位證據內容真實性,提供原創性記錄,並加速證明之效力;除了利用區塊鏈 (Blockchain) 技術具有不可篡改之特性,永久保存原創記錄外,本論文提出一套完整的定義及實作系統,其中利用區塊鏈之中有一種技術可用來確認數碼文件是否有被篡改,該技術名為「數位指紋 (Digital fingerprint)」,其原理是通過採用雜湊演算法,也有利於證明何人、何時,持有該原創的數位資料,與區塊鏈 (Blockchain) 整合應用,日後舉證時,大大提升被認可的證據力,無論是技術文件權利的主張、商業發展交易的合約或是數位證據的保護,都可以證明記錄保存的完整性與真實性,讓證據力取得變得容易且快速,省下不必要的時間及金錢成本。

In today's society, many things in daily life are related to notarization. Commonly,such as birth certificates, notarized marriages and wills, money lending, contract notarization, and real estate sales in the commercial market have the opportunity to be notarized. The effect of notarization is Assisting the parties in preventing disputes, preserving relevant evidence, and confirming the validity of relevant documents, but there is an increasing demand for originality and time-sensitive certifications such as contracts and evidence documents, and most rely on private third-party certification units, such as civil notary offices. However, these procedures are cumbersome, time-consuming and costly. In addition, both the requester and the notary public need to keep the contract paper and save it. It is also difficult to prove the originality and timeliness in the future. How to save the original efficiently? Documentary records and public, notarized methods?This study mainly uses the blockchain technology to calculate the credibility, value credibility, data credibility, method credibility, system credibility and other characteristics, and digitize the contracted papers. The authenticity of the digital evidence, providing original records and speeding up the validity of the proof; in addition to using the blockchain technology to have irreversible characteristics and permanently storing the original records, this paper proposes a complete definition and implementation. The system, in which a technique in the blockchain can be used to confirm whether a digital file has been tampered with. The technology is called "Digital Fingerprint". The principle is to use a hash algorithm to prove who, When to hold the original digital data and integrate it with the blockchain, in the future, the evidence will be greatly enhanced, whether it is the claim of technical documents, the contract of commercial development transactions or the digital evidence. Protection can prove the integrity and authenticity of record preservation, making evidence acquisition easy and fast, saving unnecessary The time and costs money.
