隨著知識經濟世代的來臨,智慧財產權已成為主導高科技產業技術發展與市場開發的工具,而其中專利權的保護與應用更是高科技公司在市場競爭中最重要的策略工具。許多研究指出很多公司不了解利用專利來當作策略資訊來源的好處,且很少利用專利資訊來當作策略規劃的目標。主要的原因是缺乏關於專利資訊方面的知識以及對專利分析應用於技術策略規劃的工具陌生。而專利分析的任務即是將專利資料做系統性的分類,將「專利資訊」轉為「專利情報」的一種技術方法,Ashton and Sen(1988)認為專利分析可以幫助企業從事技術策略規劃,建議企業將專利分析納入成為企業活動的一部份。而本研究主要的研究目的為探討專利分析對技術策略內容模式和程序模式的影響,並試圖建立一個結合專利分析的技術策略規劃模式供企業參考。 本研究為探索性研究,採用個案研究和深入訪談並進的方式,以兩家半導體廠商、一家電腦系統廠商和一家研究機構為研究對象,探討國內專利分析的應用概況和專利分析對於技術策略的影響,根據本次研究的發現產生出四個研究命題: 一、企業從事產品或技術開發活動,專利分析所提供的技術情報有助於企業決定技術研發主題。 二、企業受限於時間和人力的不足,專利地圖的投入尚在起步階段。 三、就台灣的半導體公司而言,專利分析所提供的技術情報有助於企業決定技術來源。 四、專利分析所提供的專利情報,因專利部門在組織中的地位,對於中高階主管擬定經營決策的影響力並不一致。
As the coming of knowledge-based economy , intellectual property right becomes a tool of leading technical and market development in high-tech industry ,moreover, the protection and applications in patent right is the most important strategy tool in competitive markets. Several studies show that many companies have yet recognized the benefits of patents as strategic information source and therefore rarely use patent information for strategic planning purposes. This may be generally attributed to a lack of knowledge about the advantages of patent information and more specifically on the unfamiliarity with instruments, which are based on patent data and can be used in strategic R&D planning. Aston and Sen(1988) argued that patent analysis can help company conduct technology strategic planning and suggest patent analysis as a part of their business activities. The purpose of this research is discussing about the impacts of patent analysis on content and process of technology strategy; attempting to establish a technology strategic planning of combined patent analysis for business as well. In this exploratory study, case study and in-depth interviews for data collections are both applied. We interviewed including two Semi-conductor company, one computer manufacture company, and one research institutes to explore the situation of patent analysis application and impacts of patent analysis on technology strategy in Taiwan. According to the discoveries of this study, four propositions are proposed: 1. Patent information supplied by patent analysis can assist business decide their technology exploitation goals while business engage in technology development activities. 2. Company is restricted by lacking of time and human resources, thus investment of patent map is still in the initial stage. 3. Patent information supplied by patent analysis can assist business decide technology resource in regard to semi-conductor industry in Taiwan. 4. The influence of patent information supplied by patent analysis will be different because the decision power of senior supervisors will be changed according to the status of patent department in organization.
